Discussion and Action on the following:

1.                  Call to Order

The meeting was called to order by Chairman John Klasen at 7:00PM.

2.                  Roll Call

3.                  Pledge of Allegiance

Pledge of Allegiance cited by all those in attendance.

4.                  Approve the Agenda

Motion was made by Supervisor Treml to approve the agenda.  Seconded by Supervisor Kussow.  Motion carried.

5.                  Approve Minutes from Town Board Meeting held on August 24, 2009

Motion was made by Supervisor Treml to approve the minutes from the town board meeting held on August 24, 2009.  Seconded by Supervisor Kussow.  Motion carried.

6.                  Police Department Report/Chief Randy Bani

Chief Randy Bani stated the Police Department has been very busy.  The new squad car is now in service.  The department did 14 bar checks for underage drinkers and found no violations.  A grant reimbursement from 2007 in the amount of $4,790 was received for recording equipment.  230 court cases were assigned in July and 284 in August, the Village recently accepted the resignation of the Court Clerk.  Another speed grant for was received for 2010.  Update only no action taken.

 

7.                  Open Public Hearing in Reference to a Request to construct two Seasonal Greenhouses on parcel L-512-1 and L-512-2  located at 2656/2668 Lost Dauphin Road

Motion was made by Supervisor Treml to open the public hearing.  Seconded by Supervisor Vandenack.  Motion carried.

Chris Landwehr was present to propose a seasonal greenhouse on his property (L-512-1 & L-512-2) located at 2656/2668 Lost Dauphin Road.  He stated the greenhouse would not be visible from Lost Dauphin Road or by adjacent property owners.  Access to the greenhouse will be provided off of Lost Dauphin Road. The greenhouse will only be in operation seasonally (spring/summer). 

 

Chairman Klasen asked if Mr. Landwehr had spoken with any of his neighbors.  Mr. Landwehr indicated he spoke with the adjacent property owners as well as other neighbors and they were all supportive. 

 

Chairman Klasen asked the size of the property.  Mr. Landwehr stated he has 7 acres.

 

Supervisor Kussow asked what the property is zoned.  Mr. Landwehr stated it is zoned Estate Residential.

 

Clerk-Treasurer, Judy Benz read aloud from the Town of Lawrence Zoning Ordinance the permitted conditional uses which state, horticultural, nursery, and orchard.

Supervisor Kussow suggested allowing a conditional use permit for a period of one year to determine whether or not there are any issues. 

 

Chairman Klasen asked what material the greenhouse structure is made from.  Mr. Landwehr stated it is made from polycarbonate and will be approximately 30x60’ in size with a fan on the end wall.

 

Mary Anderson-Offer, 2676 Lost Dauphin Road – stated she has no objections to the greenhouse and she is very excited for Mr. Landwehr to embark on this endeavor.  She said the proposed location is self contained and she does not anticipate there will be any problems. 

 

8.                  Close Above Mentioned Public Hearing

Chairman Klasen asked on two occasions for further testimony, with no further comments, a motion was made by Supervisor Treml to close the public hearing.  Seconded by Supervisor VanDeHei.  Motion carried.

9.                  Consider and Approve Conditional Use Permit for Resident to have two Seasonal Greenhouses on parcel L-512-1 and L-512-2  located at 2656/2668 Lost Dauphin Road

A motion was made by Supervisor Kussow to approve the conditional use permit for one greenhouse to be located on parcel L-512-1 and L-512-2 located at 2656/2668 Lost Dauphin Road for a period of one year to be brought back at the same time next year for review.  Motion seconded by Supervisor Treml.  Motion carried.  Supervisor Vandenack was in opposition of the motion and voted nay.  (See attached Conditional Use Permit)

 

10.              Preliminary Analysis of a Storm Water Utility/McMahon Associates

Town Engineer, Matt Greely provided an overview of the preliminary analysis of the Storm Water Utility. Review purposes only no action taken.

 

11.              Approve Engineer Services for the Implementation Phase in reference to a Storm Water Utility

A motion was made Supervisor Treml to approve McMahon Associates to move forward with the implementation phase relating to the Storm Water Utility.  Motion seconded by Supervisor VanDeHei.  Motion carried. 

 

12.              Approve Design for Patriot Place Pond Modification

Town Engineer, Matt Greely reviewed the design for the Patriot Place Storm Water Pond Modifications.  The new pond design will meet the 100 year flood control standards as well as the Town’s requirements.  Mr. Greely suggested a new drainage plan for Patriot Place Subdivision be recorded and on file with the Town once the modifications have been completed. 

 

Supervisor VanDeHei asked if the outflow will be increased and if it would meet the state requirements. 

 

Mr. Greely indicated the state only requires a 2 year standard.  The modifications will meet the state standards.

 

Mr. Greely stated some grading will need to be done on some of the lots and banks of the pond.

 

Earl Kinjerski, 1919 Sinclair Drive – asked if the existing outfall would be changed.  Mr. Greely stated the existing outfall will be enlarged. 

 

Supervisor VanDeHei asked about the drainage ditch to the west.  Joan Sinclair stated they are in the process of obtaining permits from the DNR to perform the work and it will be completed this fall.

 

A motion was made by Supervisor VanDeHei to approve the Patriot Place pond modifications contingent on the following:

A.          Necessary grading of any lots and the banks of the pond will be performed by the developer to the Town’s standards.

B.          Final grades must be shot and approved the McMahon Associates and the Town.

C.          All modification to the pond and re-routing of the western drainage ditch need to be completed by November 1, 2009.

D.          Upon completion of the modifications a new subdivision drainage plan must be recorded and on file with the Town.

Motion seconded by Supervisor Vandenack.  Discussion: Joan asked about the prairie grass for landscaping around the pond.  Matt Greely stated the prairie grass needed to be planted ˝ up the slope of the pond. Supervisor VanDeHei included in the motion the prairie grass plantings to be ˝ up the slope of the pond.  Motion carried unanimously.

 

13.              Request for a Payment Schedule for a Reserve Class B Liquor License/Ray Sgambati

A motion was made by Supervisor VanDeHei to table this item.  Motion seconded by Supervisor Vandenack.  Motion carried.  (Item tabled).

 

14.              Business Sign for Coaches Corner

A motion was made by Supervisor VanDeHei to approve the business sign for Coaches Corner located on Mid Valley Drive.  Motion seconded by Supervisor Treml.  Motion carried unanimously.  (See Attached Sign Plan)

 

15.              Authorize Dead Trees to be Cut in tree line on Spring Meadows Pond

Utility Manager, Greg Little stated he visited the Spring Meadows Pond site to review the maintenance needs.  Mr. Little stated he will be putting together a plan for maintenance of the site which will include:

A.          Removal of dead trees on town property

B.          Placement of stone along the banks of the pond

C.          Vegetation control and maintenance

A portion of all costs incurred will be forwarded to the Village of Ashwaubenon. A motion was made by Supervisor Vandenack to table this item to allow further information to be gathered.  Motion seconded by Supervisor Kussow.  Motion carried.  (Item tabled)

 

16.              Authorize various property owners to extend their lawn cutting onto town property surrounding Spring Meadows Pond

A motion was made by Supervisor Treml to authorize various property owners to extend their lawn cutting onto town property surrounding Spring Meadows Pond.  Motion seconded by Supervisor Vandenack.  Motion carried.

 

17.              Adopt resolution to Petition the County to add walking/bike lane on Scheuring Road and Williams Grant Dr

A motion was made by Supervisor VanDeHei to adopt a resolution to Petition the County to add walking/bike lane on Scheuring Road and Williams Grant Dr.  Motion seconded by Supervisor Treml.  Discussion: Supervisor VanDeHei stated the petition should include lanes on both sides of the road.  Motion carried. (See Attached Resolution No 0914 Series 2010)

 

18.              Approve Memo of Understanding between the Town and Brown County for the Statewide voter Registration System

Clerk-Treasurer, Judy Benz, reviewed the employee time and cost savings involved.  A motion was made by Supervisor Vandenack to approve the Memo of Understanding between the Town and Brown County for the Statewide voter Registration System.  Motion seconded by Supervisor Kussow.  Motion carried.  (See Attached Memo of Understanding)

 

19.              Request for “No Parking” signs to be removed from Cady Lane

Supervisor VanDeHei stated he visited the site on Cady Lane and is recommending the “No Parking” signs be removed.  A motion was made by Supervisor VanDeHei to remove the “No Parking” signs from Cady Lane.  Motion seconded by Chairman Klasen.  Motion carried.  Supervisors Vandenack and Treml were in opposition of the motion and voted nay. 

 

 

20.              Approve Agreement between Town and Jerry VanDenHeuvel in reference to Improvements to Little Rapids Road

A motion was made by Supervisor Kussow to approve the agreement between the Town and Jerry VanDenHeuvel in reference to Improvements to Little Rapids Road.  Motion seconded by Supervisor VanDeHei.  Motion carried.  (See attached Agreement)

 

21.              Approval on concrete pad for DADS equipment shed at Quarry Park

A motion was made by Supervisor Kussow to approve the concrete pad for DADS equipment shed at Quarry Park.  A 50/50 cost share will be split between DADS and the Town for the cost of the concrete only.   Motion seconded by Supervisor Treml.  Motion carried unanimously.

 

22.              Approve Bartender Licenses

A motion to approve the bartender license applications was made by Supervisor Vandenack.  Motion seconded by Supervisor Treml.  Motion carried unanimously.  (See Attached List)

 

23.              Option for Larger Recycling Containers for Residents

The board reviewed different options for residents requesting a larger recycling container.  A motion was made by Supervisor Kussow to approve the following options:

Option 1

Resident could switch their 95 gallon trash container to their recycling container and use their 65 gallon recycling container for trash – required cost for resident would be $46.00 for covers.  (Town would manage or additional costs would be required by Veolia)

 

95 Gallon Cover                  $24.00

 

65 Gallon Cover                  $23.00

 

Option 2

Resident could receive a 95 gallon recycling container for a one time additional cost of $75.00. (Town would manage delivery or additional costs would be required by Veolia.)  Town would then keep 65 gallon container on hand and deliver as needed to new residents.

 

Motion seconded by Supervisor Vandenack. Motion carried.

 

24.              Update on Water and Sewer Utility /Greg Little

Utility Manager, Greg Little, stated the tower construction is final some finish work needs to be completed prior to filling. Update only no action taken.

 

25.              Update on Fire Department/Kurt Minten

Chief Minten stated the department has responded to 5 false alarms and provided mutual aid to a neighboring community for a barn fire recently.  Update only no action taken.

 

26.              Payment of due invoices and wages

A motion was made by Supervisor Treml to approve payment of due invoices and wages.  Motion seconded by Supervisor VanDeHei.  Motion carried.

28.              Public Comments

Motion was made by Supervisor Treml to open the floor for comments.  Seconded by Supervisor Vandenack.  Motion carried.

 

Bob Meulemans – asked Chief Minten if the Fire Department should consider billing for fire calls.

 

Chief Minten explained the department currently bills for highway calls and repeated false alarms.

 

Mr. Meulemans stated the landscaping done by the parks signs looks great.

 

Supervisor Vandenack expressed his thanks for the graffiti removal done at the park. 

 

With no further comments, a motion was made by Supervisor Vandenack to return to regular session.  Seconded by Supervisor Treml.  Motion carried.

 

29.              Adjourn

Motion was made by Supervisor VanDeHei to adjourn the meeting.  Seconded by Supervisor Vandenack.  Motion carried.  The meeting adjourned at 9:15PM.
